Pitch Planner Terms of Use

Welcome to Pitch Planner

These Terms of Use govern your use of Pitch Planner, a service provided by WhiteBoston LLC, doing business as Pitch Planner ("we," "us," or "our"). By accessing or using the platform, you agree to be bound by these terms. If you do not agree, please do not use the service.

1. Beta Status

  • Pitch Planner is currently in beta and is provided as-is.
  • We cannot guarantee uninterrupted availability, uptime, or error-free operation.
  • Features may be added, changed, or removed as the service develops.
  • For an active paid subscription, we will not materially reduce core paid-plan functionality during a prepaid monthly billing period without reasonable notice or an appropriate remedy where required by law. We may make changes needed for security, legal compliance, fraud prevention, or technical operation.
  • Do not rely on this service as your only record for important data — keep your own backups.
  • WhiteBoston LLC d/b/a Pitch Planner is not liable for service interruptions or data loss during the beta period.

2. Eligibility

  • You must be at least 13 years old to use Pitch Planner.
  • If you are under 18, you must have permission from a parent or legal guardian.
  • Paid subscriptions are available only to customers located in the United States with a U.S. billing address. We may reject or cancel subscriptions purchased using inaccurate location or billing information.
  • By using the platform, you confirm that you meet these requirements.

3. Acceptable Use

You agree to use Pitch Planner only for lawful purposes. The following are prohibited and may result in immediate account termination:

  • Attempting to hack, disrupt, or gain unauthorized access to the service or its infrastructure.
  • Uploading or transmitting harmful, illegal, offensive, or infringing content.
  • Using automated bots, scrapers, or crawlers without our written permission.
  • Impersonating another person or organization.
  • Interfering with other users' access to or enjoyment of the service.

4. Accounts

  • You are responsible for maintaining the security of your account credentials.
  • You must not share your account with others or allow unauthorized access.
  • You are responsible for all activity that occurs under your account.
  • For a paid promotional checkout, an account is created or linked only after Stripe confirms successful payment. We use the email address supplied during checkout to create or locate the Pitch Planner account and send a secure login link. If an account already exists for that email address, the paid subscription may be linked to that account.
  • Notify us immediately at [email protected] if you believe your account has been compromised.

5. Data and Privacy

  • Tournament data may be archived after 30 days of inactivity and deleted after 60 days. Keep your own records if the data is important.
  • We collect basic usage data to operate and improve the platform.
  • We do not sell your personal data. See our Privacy Policy for full details.

6. Paid Plans, Free Trials, Billing, Cancellation, and Refunds

Paid plans. Pitch Planner may offer Pro and Premium subscriptions with monthly, six-month, or annual billing. Available plans, features, prices, promotional discounts, billing intervals, and renewal terms are displayed at checkout and may differ from prices shown elsewhere in the Service.

Regular website signup and cardless trials. Regular website signup may offer a Free plan or an eligible cardless trial. No payment method or credit card is required for a cardless trial. If you do not separately purchase a paid subscription, paid trial features end when the trial expires and the account continues on the Free plan, subject to the applicable plan limits.

Paid promotional checkout. Most promotional and paid-ad checkout offers require immediate payment and do not include a free trial or a Free account before checkout is completed. The match-day coaching offer is an exception: monthly Premium is charged at the full displayed price immediately, while yearly Premium requires a payment method and starts a three-day trial. Stripe charges the displayed introductory yearly amount when that trial ends unless you cancel first; if a payment method is missing at trial end, Stripe cancels the subscription. After Stripe confirms that the Checkout Session is completed, we create or link your Pitch Planner account and provide access to the selected paid plan.

Introductory prices. A promotional checkout may charge an introductory price for the first billing period. Unless checkout expressly states otherwise, a promotional discount applies only to the first billing period. The subscription then automatically renews at the regular price and interval disclosed at checkout.

Automatic renewal. Paid subscriptions renew automatically at the interval selected at checkout—monthly, every six months, or annually—until cancelled. You authorize us and our payment processor, Stripe, to charge your selected payment method at the beginning of each recurring billing period unless you cancel before the next renewal date.

Cancellation. You may cancel a paid subscription at any time through the Billing section of your Pitch Planner account or through the Stripe customer portal. Cancellation takes effect at the end of your then-current paid billing period. You retain paid-plan access until that date, and we will not charge you for a later billing period unless you resume or start a new subscription.

Refunds and prorating. Except where required by applicable law, payments are non-refundable and we do not provide refunds or credits for partial billing periods, unused time, downgrades, or cancellation before the end of a billing period. Cancelling a six-month or annual subscription does not generate a refund for unused months; access continues through the end of the prepaid billing period. This does not limit our ability to correct billing errors.

Plan changes. Plan upgrades, downgrades, and their effective dates are presented in the Billing section or Stripe customer portal before you confirm the change. If Stripe presents a prorated charge or credit for a change, that amount will be shown before confirmation. Downgrades take effect at the end of the current paid billing period and may reduce feature access or plan limits at that time. We do not automatically delete customer data solely because of a downgrade or trial expiration; access to features or data above the new plan's limits may be restricted or archived as described in the Service.

Taxes. Prices are stated in U.S. dollars and are exclusive of applicable sales, use, or similar taxes unless stated otherwise at checkout. You are responsible for applicable taxes, and Stripe may collect them where required.

Failed payments. If a payment fails, we or Stripe may retry the payment and ask you to update your payment method. We may limit or suspend paid features while your account is past due or unpaid. If payment is not resolved, we may cancel the subscription, restrict access, or move the account to the Free plan when that option is available.

Price changes. We may change subscription prices prospectively. We will provide at least 30 days' advance notice by email or through the Service before a price change takes effect. If you do not agree, you may cancel before the new price takes effect.

Billing errors and unauthorized charges. Contact us promptly at [email protected] if you believe a charge is incorrect or unauthorized. We will investigate the issue and, where appropriate, work with Stripe to correct it. You may also contact your financial institution, subject to its procedures and applicable law.

Billing processor. Payments are processed by Stripe. Your use of Stripe's checkout and customer portal may also be subject to Stripe's terms and privacy policy. See our Cancellation & Refund Policy for a plain-language summary of these billing terms.

7. Intellectual Property

  • All code, design, branding, and content of Pitch Planner are owned by WhiteBoston LLC d/b/a Pitch Planner and protected by copyright and other intellectual property laws.
  • You retain ownership of the tournament data you create, but you grant WhiteBoston LLC d/b/a Pitch Planner a limited license to store, display, and process it as necessary to provide the service.
  • You may not copy, reverse-engineer, decompile, or create derivative works from any part of the platform without our written permission.

8. Limitation of Liability

  • Pitch Planner is provided "as is" without warranties of any kind, express or implied.
  • WhiteBoston LLC d/b/a Pitch Planner does not warrant that the service will be uninterrupted, error-free, or free of harmful components.
  • To the fullest extent permitted by law, WhiteBoston LLC d/b/a Pitch Planner is not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the platform.
  • Our total liability to you for any claim arising from these terms or your use of the service shall not exceed the amount you paid us in the 12 months prior to the claim (which is $0 for free accounts).

9. Indemnification

You agree to indemnify, defend, and hold harmless WhiteBoston LLC d/b/a Pitch Planner and its owners, employees, and agents from and against any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising from your use of Pitch Planner, your violation of these Terms of Use, or your violation of any applicable law or third-party rights.

10. Account Termination

  • We may suspend or terminate your account at any time for violations of these Terms or for any other reason at our sole discretion.
  • You may close your account at any time by emailing [email protected].
  • Upon termination, your access to the platform will be removed. Tournament data associated with your account may be deleted after 30 days.

11. Third-Party Links

Pitch Planner may contain links to third-party websites or services. We are not responsible for the content, privacy practices, or availability of those external sites. Accessing them is at your own risk.

12. Changes to These Terms

  • We may update these terms at any time. The "Last updated" date at the top of this page reflects the most recent revision.
  • Significant changes will be communicated by email.
  • Continued use of Pitch Planner after changes take effect constitutes your acceptance of the updated terms.

13. Jurisdiction

These terms are governed by the laws of the State of Texas, without regard to its conflict of law provisions. Any disputes arising from these terms or your use of Pitch Planner will be resolved in courts of competent jurisdiction in Texas.

14. Severability and Entire Agreement

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or removed to the minimum extent necessary, and the remaining terms will remain in full force and effect.

These Terms of Use, together with our Privacy Policy and Cancellation & Refund Policy, constitute the entire agreement between you and WhiteBoston LLC d/b/a Pitch Planner regarding your use of Pitch Planner.
